3. Client Responsibilities & Compliance with Telecommunication Laws

You are solely responsible for how you deploy our automated messaging and calling tools. You represent and warrant that:

- You comply with all applicable local, state, federal, and international laws, including the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and relevant telemarketing regulations.

- You have obtained all necessary prior express consents or disclosures from leads and end-users before initiating automated calls, artificial voice communications, or text messages through the Services.

- You will not use the Services to transmit spam, unlawful content, defamatory material, or deceptive solicitations.

4. Fees and Payment Terms

- Subscription Fees: Access to services is provided on a recurring subscription or setup-fee basis as outlined in your service agreement or checkout page.

- Billing: Fees are billed in advance and are non-refundable unless explicitly stated otherwise in a written guarantee.

- Third-Party Telephony/Carrier Charges: Usage fees (such as carrier charges, Twilio SMS/voice fees, or related AI computation units) may be billed separately based on consumption.

5. Intellectual Property

All software, algorithms, workflows, branding, logos, and materials provided by AI Captures Leads are the exclusive intellectual property of the Company or its licensors. You are granted a limited, revocable, non-transferable license to utilize the platform for internal business operations during your active subscription term.

6. Service Availability and AI Limitations

- While our systems are engineered for high availability and natural conversation, you acknowledge that artificial intelligence technologies can occasionally make factual errors or experience temporary service interruptions.

- AI Captures Leads does not guarantee specific lead conversion rates, exact revenue targets, or uninterrupted uptime.

7. Fair Usage Policy

Your AI Receptionist is designed to answer your normal day-to-day business calls 24/7/365 without requiring you to count every call or minute.

AI Captures Leads includes generous AI voice usage for normal business use. There is no per-call charge for ordinary usage included with your plan.

If your account experiences unusually high or excessive call volume that significantly exceeds normal usage for your plan, we will contact you before making any changes. We may recommend a higher-volume plan or customized pricing based on your actual usage.

You will never receive a surprise overage charge without prior notice.

8. Limitation of Liability

To the maximum extent permitted by applicable law, AI Captures Leads and its affiliates, officers, or contractors shall not be liable for any indirect, incidental, punitive, or consequential damages, including loss of profits, lost data, customer disputes, or carrier fines resulting from your use or misuse of the platform.

9. Termination

We reserve the right to suspend or terminate your account immediately if you violate these Terms, engage in unlawful messaging practices, or fail to make scheduled subscription payments.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.
